Terms of Service

These Terms of Service ("Terms") govern your use of the Timeless Atelier website, platform, customer account, bespoke project services, and related services.
By using Timeless Atelier or entering into a transaction or project through the platform, you agree to these Terms and any additional terms specifically presented and accepted for the applicable order or project.
1. Timeless Atelier
Timeless Atelier provides a platform for discovering independent jewelry designers and jewelers, exploring jewelry, initiating bespoke projects, communicating about projects, and accessing related services.
Depending on the transaction, products or services may be provided by Timeless Atelier, an independent designer, an independent jeweler, a production specialist, an affiliated company, or another identified project participant.
2. Independent Designers and Jewelers
Designers, jewelers, gemstone specialists, manufacturers, and other professionals participating in a project may operate as independent businesses or professionals.
Their specific role, responsibilities, pricing, production obligations, and other project terms may be stated in the relevant proposal, project record, agreement, invoice, or other written confirmation.
3. Bespoke Projects
Bespoke jewelry projects are individualized and may include consultation, design development, concept visualization, gemstone selection or sourcing, CAD or engineering, manufacturing, setting, finishing, shipping, and other project-specific services.
The exact scope of each project will depend on the written terms, approvals, and decisions made for that project.
4. Project Information
Customers are responsible for providing information that is reasonably accurate and complete, including preferences, measurements, budget information, deadlines, gemstone information, shipping details, and other project requirements.
Material changes to project information may affect price, design, technical feasibility, and completion timing.
5. Estimates and Quotations
Early discussions, examples, AI-generated concepts, preliminary recommendations, and initial budget discussions are not necessarily final quotations.
A project price becomes binding only when identified as an accepted quotation, invoice, contract, project scope, or other confirmed commercial agreement.
6. Payments
A bespoke project may require one or more payments, including consultation fees, design fees, gemstone payments, material deposits, production deposits, progress payments, final balances, shipping charges, taxes, or other agreed project costs.
The applicable payment schedule will be disclosed for the specific project.
Failure to make a required payment may result in the project being paused, delayed, or cancelled in accordance with the applicable project terms.
7. Deposits
A deposit does not necessarily represent the entire price of a bespoke project. Its refundability depends on the purpose of the deposit, work performed, materials committed, project stage, specific agreement, and applicable law.
8. Design Development and Revisions
A bespoke project may involve one or more rounds of discussion or design revision. The number of included revisions, if limited, should be stated in the applicable project terms.
Material changes requested after approval may require additional fees, revised production timing, or new approval.
9. AI-Assisted Concepts and Visualization
Timeless Atelier may provide AI-assisted concept generation, hand-drawn-style visualization, 3D visualization, matching assistance, or other technology-supported tools.
AI-generated outputs are intended for inspiration, communication, and design discussion. They may contain inaccuracies or features that are technically, structurally, materially, or commercially unsuitable for production.
Selecting, saving, or sharing an AI-generated concept does not by itself constitute authorization to manufacture that concept.
Final design development, engineering, gemstone selection, production feasibility, craftsmanship, and manufacturing approval remain subject to professional review and the applicable project process.
10. Design Approval
When a project reaches a stage requiring client approval, the customer is responsible for reviewing the materials reasonably provided, which may include dimensions, materials, gemstones, images, drawings, renderings, CAD, price, or other project specifications.
Approval applies to the version and scope presented at that time. A material subsequent change may require renewed approval.
11. Gemstones
Gemstones may be supplied by a client, designer, jeweler, Timeless Atelier, affiliated company, or other supplier.
Relevant information such as gemstone identity, dimensions, treatment disclosures, laboratory reports, price, origin claims, or other material information should be documented where applicable to the transaction.
Natural gemstones may contain variations and characteristics inherent to natural materials. Photographs and screens may not reproduce color or appearance exactly.
12. Client-Owned Gemstones and Jewelry
Customers must disclose any known information that may materially affect the safe handling or use of client-owned stones or jewelry.
Before irreversible work is performed, the applicable scope, handling arrangement, and material risks should be reasonably communicated.
13. Intellectual Property and Design Rights
Ownership and usage rights in original designs, drawings, CAD files, photographs, concepts, and other creative materials may belong to the relevant designer, creator, Timeless Atelier, or another rights holder.
Payment for a jewelry item does not automatically transfer copyright, design rights, CAD files, manufacturing files, or other intellectual property unless expressly agreed in writing.
14. Customer-Provided Content
When you upload photographs, inspiration, sketches, text, or other content, you represent that you have the right to provide that material for the requested project use.
You grant Timeless Atelier and authorized project participants a limited right to use that material as reasonably necessary to evaluate, design, manage, produce, and complete your project.
15. Publicity and Portfolio Use
Private project materials are not automatically authorized for public marketing use. Where Timeless Atelier, a designer, or another participant wishes to use identifiable private project materials for advertising, social media, portfolio, or promotional purposes, separate permission may be requested where appropriate.
16. Designer Applications
Submitting a designer or jeweler application does not guarantee acceptance, create a public profile, grant designer privileges, or guarantee project opportunities.
Applications are subject to review. Timeless Atelier may request additional information, verify submitted evidence, approve, reject, or request supplementation of an application.
Approval of an application does not automatically mean that a public profile, matching eligibility, or availability to accept projects has been activated.
17. Product Availability
Jewelry, gemstones, materials, designer availability, and production capacity may change before a transaction or project is confirmed.
18. Timing
Project and delivery timelines are estimates unless expressly guaranteed. Timing may be affected by client approvals, revisions, gemstone sourcing, production complexity, laboratory work, shipping, customs, or other factors.
19. Shipping
Shipping is subject to the Timeless Atelier Shipping Policy and any project-specific shipping terms.
20. Returns and Cancellations
Returns, cancellations, and refunds are subject to the Timeless Atelier Returns, Cancellations & Refunds Policy and any applicable project-specific terms.
21. Accounts and Security
You are responsible for maintaining the confidentiality of your account credentials and for activity occurring through your account.
You must not attempt to access another user's private projects, designer-only functionality, administrative systems, or other restricted areas without authorization.
22. Acceptable Use
You may not use Timeless Atelier for fraud, infringement, unauthorized access, harassment, unlawful activity, malicious software, or conduct that materially interferes with platform operation.
23. Third-Party Services
Certain functions may rely on third-party payment providers, shipping providers, video or communication platforms, cloud services, artificial intelligence providers, or other technology services.
Use of those services may also be subject to their applicable terms and policies.
24. Warranties and After-Sales Service
Warranty or after-sales coverage may vary depending on the item, designer, manufacturer, project, and written terms provided with the transaction.
No warranty should be assumed beyond the written warranty or rights provided for the applicable transaction and any non-waivable rights under law.
25. Disclaimers
To the extent permitted by applicable law, Timeless Atelier does not guarantee that preliminary concepts, matching recommendations, estimated timelines, or AI-assisted outputs will result in a particular aesthetic, commercial, technical, investment, or resale outcome.
Nothing in these Terms excludes responsibilities or consumer rights that cannot legally be excluded.
26. Limitation of Liability
To the maximum extent permitted by applicable law, any limitation of liability will be interpreted in light of the actual role of Timeless Atelier and the applicable project participant, the nature of the transaction, any project-specific agreement, and rights that cannot legally be waived.
27. Changes to These Terms
We may update these Terms from time to time as our services, technology, and business operations evolve.
Changes will apply prospectively unless otherwise permitted by law. They do not retroactively replace valid terms already agreed for an existing project unless the parties lawfully agree otherwise.
